Washington Jurat Certificate: Wording, the Residence Line and the Notario Ban

This content is educational and informational, not legal advice. Requirements reflect chapter 42.45 RCW and chapter 64.08 RCW, but the law can change. Confirm current requirements with the Washington Department of Licensing before relying on this.

Quick answer: The Washington jurat, called a verification on oath or affirmation, reads "Signed and sworn to (or affirmed) before me on (date) by (name) making statement." Washington keeps a residence line most states dropped decades ago, and it bars a notary from calling themselves a notario público — a rule aimed squarely at protecting Spanish-speaking clients.

Why does a Washington certificate say "residing at"?

Because chapter 64.08 RCW has the notary's signature followed by "Notary Public in and for the state of Washington, residing at," giving the place of residence. Most states abandoned residence lines decades ago, so out-of-state recipients see it as an oddity and sometimes query it. The entry names a city or town, not a street address, and it sits alongside the official stamp rather than inside it. Washington recording offices look for it, so include it rather than trimming the block to match a national template.

Can a Washington notary be called a "notario público"?

No. A Washington notary who is not an attorney licensed in the state, or a Washington-licensed limited license legal technician acting within their scope, may not use the terms "notario" or "notario publico." The ban exists because across much of Latin America a notario público is a highly trained lawyer with broad powers to draft instruments and give legal advice. A US notary can do none of that. Using the term misleads Spanish-speaking clients into believing they have hired a lawyer, which is why Washington treats it as misconduct rather than a marketing choice.

Explain in general what each act does Use the terms "notario" or "notario publico"
Hand you the statutory forms Assist you in selecting the appropriate certificate
Refuse an act on defined grounds Act where they, a spouse or a domestic partner is a party

When can a Washington notary refuse?

On two distinct grounds, and it is worth separating them. A notarial officer has authority to refuse if not satisfied that the individual executing the record is competent or has the capacity to execute it, or that the individual's signature is knowingly and voluntarily made. The first is about the person's ability to understand what they are doing; the second is about whether anyone is pushing them. A signer who understands the document perfectly but is being pressured by a relative fails the second test even though they pass the first. Washington notaries may also require additional information or identification credentials to be satisfied of identity.

Can a Washington notary act if their partner is a party?

No, and Washington draws the line wider than most. A notarial officer may not perform a notarial act with respect to a record to which the officer, the officer's spouse, or the officer's domestic partner is a party, or in which any of them have a direct beneficial interest, and a notary may not notarize their own signature. An act performed in violation of that subsection is voidable, which Washington states outright rather than leaving to litigation. Including domestic partners closes a gap that a spouse-only rule leaves open.

What else does a Washington jurat involve?

The definition tells you what you are certifying: a verification on oath or affirmation is a declaration, made by an individual on oath or affirmation before a notarial officer, that a statement in a record is true. Note the emphasis on the statement rather than the signature, which is the clean way to explain the difference from an acknowledgment. Washington also allows a notarial officer to certify that a tangible copy of an electronic record is an accurate copy, which matters when a document notarized electronically has to be recorded or apostilled on paper.
