Nevada Jurat Certificate Form: Wording, the Oath Script and Subscribing Witnesses

This content is educational and informational, not legal advice. Requirements reflect chapter 240 of the Nevada Revised Statutes, but the law can change. Confirm current requirements with the Nevada Secretary of State before relying on this.

Quick answer: The Nevada jurat under NRS 240.167 reads "Signed and sworn to (or affirmed) before me on (date) by (name of person making statement)." Nevada scripts the oath itself, and it insists the signer answer out loud. It also prints a rare second form: a jurat for a subscribing witness who watched someone else sign.

What is the Nevada jurat wording?

Short, and conditional on meeting the requirements in NRS 240.1655 first.

State of Nevada
County of ______

Signed and sworn to (or affirmed) before me on ____________ (date) by ____________ (name(s) of person(s) making statement).

___________________________________
Notary Public, State of Nevada
Appointment No.: ______
My commission expires: ______

What oath does a Nevada notary say?

The Secretary of State supplies the words, which spares Nevada notaries the improvisation that states like Colorado leave them with. An oath for a jurat requires the notary to ask "Do you swear that the statements in this document are true so help you God?" or, for someone who prefers not to swear, "Do you affirm that the statements in this document are true?" The notary administers this first, by swearing in the document signer, before the certificate is completed. Choosing between the two versions is the signer's call, not the notary's.

Does the signer have to answer out loud in Nevada?

Yes. Nevada requires the document signer to verbally answer or otherwise communicate an affirmative response, such as "Yes." A nod, a shrug, or silence does not complete the oath, and a certificate signed after a silent exchange states something that did not happen. The wording "or communicate" leaves room for a signer who cannot speak, which matters in hospital and care settings. What cannot be skipped is the exchange itself.

Step What Nevada expects
1 The signer appears and is identified
2 The notary administers the oath or affirmation aloud
3 The signer answers affirmatively, verbally or by communicating
4 The signer signs in the notary's presence
5 The notary completes the certificate, stamp and journal entry

What is a jurat of a subscribing witness?

A second, rarer Nevada form, printed in NRS 240.1685, used when the person who signed the document cannot appear but someone who watched them sign can. The witness personally appears before the notary, is known to the notary as the person signing the jurat, and swears under oath that he or she was present and witnessed the named signer sign his or her name to the document. The certificate then closes with "Signed and sworn before me on (date) by (subscribing witness)." Very few states print a statutory jurat for this situation at all, so it is worth knowing Nevada does.

What if a Nevada signer acts in a representative capacity?

They have to say so out loud, not just sign with a title. If the document is signed in a representative capacity, for example by an officer of a corporation, the person must declare that he or she signed the document with proper authority and executed it as the act of the person or entity represented. That declaration happens in front of the notary alongside the oath. Chapter 240 also prints separate short forms for administering an oath or affirmation of office and for an acknowledgment taken through a credible witness.

What else does a Nevada jurat require?

A journal entry and a compliant stamp. Nevada requires a notary to keep a journal of every notarial act, so the jurat is recorded alongside the date, the type of act, the identification relied on, and the fee. The Nevada stamp carries the notary's appointment number, which is unusual, along with the name, the words "Notary Public" and "State of Nevada," the county, and the expiration date. A certificate with a clean stamp but no appointment number is incomplete under Nevada law.
